
(On a total aside, doesn't that just sound DIRTY?!)
Well, I listened in on the oral arguments this morning. I missed the first half hour, as the livestream wasn't letting me in (too much traffic, I guess). By the time I was able to watch, they were on the last presenter in favor of repealing Prop 8. I must say, I was disappointed by what I saw and heard. The attorney seemed to be quite the bumbler while being grilled by the justices. There was a lot of, "well... uh... but... you know... like." etc. ARGH! Is that really the best we could do?
When Ken Star got up to speak, his confidence and eloquence flowed. Sure, he's a schmuck, and he is arguing the other side. But I cannot dismiss the fact that he is a very good and successful attorney.
The justices asked some very good questions of all the attorneys, and did not show (in my opinion), an opinion one way or another. There was a lot more "Why should we/why should we not?" hyperbole than anything else.
Fortunately, the rebuttals to Mr. Star were last. And there, I believe, is where the anti-prop 8 attorneys did well. They concentrated more on case law and upon the facets and impacts of Prop 8. My gut instinct says that the justices will not retroactively invalidate marriages. But whether more marriages will be allowed is another issue.
Now to wait until a decision is rendered.
If the judges do the right thing and strike down Prop 8, what is left of the uber-conservative right-wing will do everything in their power to try and recall the justices. Once again, DIRTY POOL! Not that I'm surprised.
